KSA Updates Online Gambling Advertising Rules

In the Netherlands, the regulator KSA on February 24 updated the rules governing the use of public figures in online gambling advertising, banning operators from using influencers and requiring existing collaborations to be terminated as quickly as possible.

Ban on the Use of Influencers and Streamers

The regulator clarified the application of the so-called role model ban, which applies to online gambling advertising.

The ban covers influencers, streamers, bloggers, vloggers, and other online personalities whose presence in advertising may influence audiences.

Reasons for the Stricter Rules

According to the KSA, such public figures are often perceived as role models, especially by minors and young adults.

This factor formed the basis for clarifying and expanding the existing ban.

Requirements for iGaming Operators

Licensed iGaming operators in the Netherlands are subject to a full ban on the use of role models in advertising.

Operators are required to terminate any existing partnerships with influencers and streamers within the shortest possible timeframe.

Differences for Lotteries

For lottery operators, the restrictions apply in part.

The ban covers the use of individuals under the age of 25 as well as personalities with a large audience among minors.

Who Is Considered a Role Model

The KSA emphasizes that the ban is not limited to well-known media figures.

Any person with public recognition is considered a role model if their reach is large enough for advertising and acquisition purposes.

Such individuals may not be used to promote or advertise online gambling, regardless of format or platform.
