Argentina Introduces New Federal Rules for Online Gambling Advertising

The Ministry of Economy of Argentina on November 3 published Resolution No. 446/2025, establishing the first nationwide regulations for online gambling advertising.

Key Requirements for iGaming Advertising

Under the new rules:

  • All advertising must include the warning “Compulsive gambling is harmful to health” and the “+18” label
  • Warnings must appear at the bottom of the ad across the full width, covering at least 10% of the total height, in bold font with contrasting colors
  • Influencers are required to display warnings during sponsored integrations
  • In radio ads, the warning must be spoken at the end of the ad without background music
  • Violators will be fined under Consumer Protection Law No. 24.240 and the Fair Trading Decree 274/2019
  • The resolution takes effect on December 3

Changes Compared to Previous Regulations

Resolution No. 446/2025 repeals the previous Resolution No. 12/2024 and establishes the first federal standard for online gambling advertising.

Requirements for Different Channels

TV and Digital Advertising

Warnings must remain on screen for at least 5 seconds, or the entire duration if the ad is shorter. For digital platforms, text must be clearly readable and accessible.

Radio Advertising

Warnings must be spoken at the end of the ad without background music and at a normal speaking pace.

Influencer Advertising

Influencers are required to display warnings throughout the integration. Violations can be reported through a dedicated complaint channel.

Additional Rules for iGaming and Ticket Sales

  • All advertising must include information about the seller: name, address, CUIT, terms of sale, and restrictions.
  • Prices and financing terms must be clear, with references to the website or 0800 hotline mandatory.
  • If tickets are sold via third-party sites, it must be clearly stated: “ESTE ES UN SITIO DE REVENTA DE ENTRADAS”.
  • Compliance with these rules does not exempt from other legal requirements, including laws on alcohol and medical products.

Monitoring and Sanctions

Violations of the rules will result in fines under consumer protection and fair trading laws. A dedicated channel has been introduced for reporting breaches.
