KSA flags marketing violations by operators

In the Netherlands, the gambling regulator KSA identified violations of marketing regulations by operators TonyBet, Betcity, and Kansino.

Marketing regulation breaches

The review found that the operators’ advertising activities reached vulnerable player groups, including audiences aged 18–24.

Under current rules, operators are prohibited from sending marketing messages or deliberately displaying advertising to such groups, as this may increase the risk of problematic gambling behavior.

TonyBet marketing emails

TonyBet sent promotional emails to groups of young players on two separate occasions.

The company explained that the incidents were caused by a system error: the software incorrectly identified players aged 18–24 as adults, which resulted in them receiving marketing communications.

Betcity advertising in the site interface

Betcity displayed a marketing message directly within its website interface, making it visible to all users, including younger players.

The operator stated that players in the 18–24 age group were not able to use the promoted marketing offer.

Kansino advertising in mobile apps

A separate violation was identified involving Kansino, which placed advertising materials in mobile gaming apps unrelated to gambling.

This form of promotion is prohibited: gambling operators are not allowed to advertise or recruit players in other online games that are not related to gambling.

Kansino’s response

Kansino reported the violation to the regulator on its own initiative. According to the company, the advertising was discovered shortly after placement and was removed immediately.

Self-reporting by operators

All three operators — TonyBet, Betcity, and Kansinovoluntarily reported the identified violations to the regulator.

Following discussions, KSA stated that TonyBet and Betcity promptly implemented corrective measures, including additional checks of marketing systems and the introduction of a dual-control principle.

KSA’s position

KSA emphasized the need for strict oversight of the use of software and marketing tools.

The regulator noted that any errors or lack of attention in system configuration can lead to contact with vulnerable player groups, including young adults, and confirmed that it will continue monitoring compliance across the Dutch gambling market.
